Confirming Orders: When a confirmation order is sent, PLEASE be sure to mark the order as CONFIRMATION. Without this notation your order may be duplicated. Orders duplicated because of this are the customer's responsibility.

Add-On Orders:

  1. All prices and product listings are subject to change without notice. Trojan, Inc. reserves the right to change prices to those in effect at the time of shipment.
  2. Payment terms: 2% 10 days, net 30
  3. All orders are subject to acceptance by the Trojan, Inc. credit department.
  4. Delivery dates furnished by Trojan, Inc. are estimated only and Trojan, Inc. assumes no responsibility in the event of a delay in shipment.
  5. Responsibility for safe delivery is assumed by the freight carrier upon acceptance of the shipment at the shipping point. If any damage occurs in transit, do not refuse shipment as this may incur unnecessary shipping expense and delay. File a claim with the carrier for your loss or damage. The carrier is responsible for breakage in transit. Trojan, Inc. will assist you in every possible manner in collecting your claims for loss or damage.
  6. No items that have been discontinued will be accepted for credit. Credit will not be issued for items that have been held for six months from date of original invoice.
  7. Errors on phone orders will be considered customer errors (confirming purchase orders minimize the risk of error).

When Your Shipment Arrives

  1. Examine the cartons closely.
  2. Write the number of damaged or lost cartons on all receipts. Make sure the driver signs all bills denoting proof of damage.
  3. Save the cartons and damaged merchandise for inspection by the freight carrier.
  4. Concealed damage must be reported to the freight carrier within two days of delivery.
  5. In the event of lost or damaged merchandise, notify our office and the original freight bill will be forwarded so you may file a claim.
Claims for losses or damages incurred during transit should be reported directly to the carrier immediately upon receipt of the shipment. Trojan, Inc. assumes no responsibility for the collection of loss claims.

Restocking Charge: Products can only be returned after the Returned Goods Authorization (RGA) has been issued. Unauthorized returns will be refused. Products returned that were shipped correctly will be credited at invoice value less a 25% restocking charge and all freight charges. No debit memos will be accepted.

Private Label Program

Trojan, Inc. manufactures many lamps which are sold under our Private Label Program. The distributor's name and logo appear on the bulb. This can be a great marketing tool for repeat orders. The following conditions and policies apply to the Private Label Program.
  1. Minimum initial order is 10 cases; standard case quantity. Additional order minimum is 5 cases; standard case quantity.
  2. An initial etch charge will be made. All etches remain the property of Trojan, Inc.
  3. All orders must be in writing and include wattage, voltage, hours, bulb size and color. Also include a sketch of the logo.
  4. Trojan, Inc. reserves the right to require a cash deposit.
  5. Quantity shipped may vary + or - 10% from the original order quantity.
  6. All Private Label lamp orders are firm, non-cancelable and non-returnable except as warranted.

Freight Policy

  1. Pre-Paid Shipping must be to a single destination.
  2. Trojan, Inc. reserves the right to select the origin and method of shipment.
  3. Special shipping or handling charges will be billed to the purchaser.
Drop Shipment: Drop shipped orders to multiple destinations for less than pre-paid order value will be charged a service charge of 5% of face value of the invoice or $20.00, whichever is greater. Freight charges will be governed by Trojan, Inc.'s freight policy. Refused or returned drop shipment orders will be credited at original invoice amount less 25% plus all freight charges incurred. There will be a service charge of $10.00 for each proof of delivery required.

Limited Warranty

Hytron® lamps are unconditionally guaranteed against any manufacturing defects. There are no implied warranties of merchantability or any other express or implied warranties which extend beyond the description on face hereof.

Exclusions from Warranty

Abuse: Trojan, Inc. shall not be responsible for claims arising from abuse of the product: (a) due to improper installation practices or procedures; or (b) due to abuse by the ultimate user.

Design: Trojan, Inc. shall not be responsible for claims resulting failure from improper design of the end product upon which Trojan, Inc.'s product is installed, such as (but not limited to) subjection of Trojan, Inc's product to conditions which exceed the rated capacity of the product and/or operating conditions which constitute improper usage.

Inspection: Trojan Inc.'s warranty is condition on substantiation that the Purchaser's incoming inspection and product line procedures are deemed defective and within accepted industry standards.

Products can be returned after a Returned Goods Authorization (RGA) has been issued. Transportation for these products is to be pre-paid, to the factory. Unauthorized returns will be refused. Any improper use, operation beyond capacity, substitution of parts not approved by Trojan, Inc., or any alteration or repair by others in such manner as in Trojan, Inc.'s sole judgment effects the product materially and adversely, shall void this warranty. No employee or representative of Trojan, Inc. is authorized to change, broaden or extend this warranty in any way, or grant any other warranty.

Lamp life and lumens made available to Purchaser by Trojan, Inc. are approximate, represent average performance only, and do not constitute any expressed or implied warranty of lamp life or lumens output.

The warranties and remedies set forth above are exclusive and in lieu of all other warranties, whether statutory, expressed or implied, including all warranties of merchantability and fitness for particular purpose and all warranties arising from course of dealing or usage of trade.

Policy for Customer-Supplied Lamps to be Coated

  1. The customer is responsible for shipping both to and from our plant. The customer must make all necessary arrangements with the trucking company being used. Our shipping department can assist you with these arrangements.
  2. The customer is responsible for any damage that might occur during shipping and during the coating process.
  3. The customer must meet the minimum quantity required to reach the set lot charge. Failure to do so will result in a set-up charge being added to the coating cost. These charges are regulated by lamp size and type.
  4. Lamps are inspected for integrity and physical defects before shipment.
  5. This policy can change without notice.
